Does Foundation Repair Require a Permit?

drainage for foundation walls

If you require repairs to the foundation of your Hamilton home, you may be wondering whether or not you will need to obtain a permit from the city before work can commence. Generally speaking, minor repair work such as waterproofing does not require a permit however other more extensive repairs, such as those that require excavation and underpinning do.

If a contractor ever tries to tell you that this kind of work does not require a permit, it should be a big red flag.

If you are employing a reputable contractor such as Conterra Foundation & Repair, they will be able to tell you whether or not your specific foundation repair will require a permit, and most contractors will even apply for the permit on your behalf.

Why getting a permit for foundation repair is important:

A permit ensures that the job is going to be performed safely and be done according to the Ontario Building Code. Foundation repair can do a lot to increase the value of your home – but only if that repair is properly permitted.

If you begin a foundation repair on your home and you do not have a permit, the City of Hamilton enforcement officers could insist that all work be ceased until the proper permits are obtained. And you do not want to find yourself in a situation where excavation has begun around your home, and the project suddenly gets delayed by several days or even weeks while you work to resolve the issue!

Is an engineer’s report required?

Yes. In order to get a building permit from the City of Hamilton, you will also need to get a structural engineer’s report (your foundation repair contractor should obtain this for you). The fee for the engineer’s report is generally included in the overall price that the contractor quotes you, but if it is not itemized in the quote or if you are unsure, ask them.

Avoid trouble selling your home

When the time comes to sell your Hamilton home, one of the first things a home inspector will look at is the foundation. If he or she notices that repairs have been done, they are going to ask you for documentation and permits which will let them know who conducted the repairs and when they were done.

If the work is unpermitted, it could cause you to lose the sale or significantly lower your price if you need to appease the buyer.
